Fall in number of mortgage writs in Northern Ireland

The Court Service of Northern Ireland have reported a fall in the number of people being taken to court for failing to pay their mortgages.

The third quarter of 2010 (July-September) saw 863 writs and originating summonses issued.  In comparison, the figure for the third quarter of last year was 1,124, representing a 23% decrease.  It is important to note that not all of these writs or originating summonses lead to eviction or repossession.

 

The process, in general terms, involves the plaintiff commencing an action for an order for possession of property.  Following a judicial hearing, the court may grant an order for possession.  This then entitles the plaintiff to apply to have the defendant evicted.

 

However, it is important to note, even where an order for eviction is issued, the possibility for negotiation between the involved parties remains.
